Bharat Forge v their workers: a flawed precedent?

labour bar_exam advanced judgment_take

I strongly disagree with the Supreme Court's decision in Bharat Forge Ltd. v. Workers of Bharat Forge Ltd. (2012). The court's attempt to limit the application of the 2010 amendments to the Industrial Disputes Act is misguided. The court's emphasis on the 'managerial freedom' of companies ignores the fact that Indian labour laws are designed to protect workers, not just employers. The judgment sets a bad precedent by allowing companies to unilaterally terminate workers without sufficient cause, violating the spirit of the Industrial Disputes Act. This decision has significant implications for workers' rights and the broader labour market. As law students, it's essential to critically evaluate this judgment and consider its impact on the lives of ordinary people.

Main aapke point of view se nahin khete hain, Bharat Forge vs workers ka case galat precedent to nahi hai. Yeh court ka faisla tha ki factory workers ke haath mein kaam karne ke liye koi khatarnaak prabandhan nahi tha, jisse koi bhi unke dastavez par aadharit case ban sakta tha.

Bhai, don't lose hope! Bharat Forge vs Workers is indeed a flawed precedent, ek chamatkaar case. It sets a bad precedent for employers to misuse the ESMA, exploiting their workers. But, yeh don't forget, it's a Supreme Court decision, toh humein isse learn karna hai. Agar aapko feel hoti hai ki workers ka haq nahin suna gaya, toh aapko humse nahi, SC se sammaan karna hai. Keep discussing, bhai!

"Yeh thread bahut zaroori hai, maine is case ko padha tha. Bharat Forge k against workers ke labor laws ka apnaan karke, Supreme Court ne yeh precedent set kiya hai. Lekin yeh precedent flawed hai kyonki court ne factory act, payment of wages act, aur other laws ka apnaan karke, workers ke rights ko samajhne mein koi farq nahi kiya.

Kya hai ye jhagda mere vichar se bhi related hai. Bharat Forge ka case kuch sahi nahi hai, lekin hamari SC bhi nahi aise hi galat hai. Unki decision ka koi permanent impact nahi pahuncha hai. Humne Supreme Court ke Judgments mein bahut study ki hai, aur mehsoos hai ki iska impact aaj bhi bahut kam hai.
