The M.P. Sharma Case: A Landmark CPC Ruling
cpc clat_ug advanced real_caseArre, guys! So I'm trying to understand this CPC thingy for CLAT and I stumbled upon this old case - M.P. Sharma vs. Satish Chandra, Delhi Administration. It's from 1954, but still super relevant. So, the court ruled that personal liberty is more important than administrative convenience. They said that no authority can enter someone's house without a warrant, except in cases of emergency. But here's the thing - it's a 6:5 verdict, with five judges saying it's okay to enter someone's house without a warrant in certain situations.
What do you guys think? Is this a just judgment or is it against Article 20(3) which talks about protection from self-incrimination? Do you agree or disagree with this ruling? I'm totally lost!
