Supreme Court's Interpretation of 'Company' in Section 2(20) of the Companies Act

Maine dekha Supreme Court ka judgment Shriram Capital Ltd. v. Seesharam Poddar (2020) 2 SCC 129. Yeh court ne Section 2(20) ko samjha ki 'company' ka definition hai kya? Pehle, isne yeh section Company of 1956 mein tha, ab Companies Act, 2013 mein. Supreme Court ne yeh kaha ki Section 2(20) mein shabda 'company' ka matlab hai ki company ki sankhya mein 2 se adhik sharika ho sakte hain. Lekin jab unhone 2020 mein yeh judgment diya, to kaha unke pas Section 2(20) mein unke pas koi suchna nahi thi.

Main aapki baat se na manoonga, "Company" ki definition ko extend karne se. SC ke anusaar, iska matlab sirf corporate entities hai, but main kahaunga ki aapne Section 40-A ka reference kyun nahin diya, jo cooperative societies ko bhi company ke taur par treat karta hai. In donon ka interpretation ek saath karne se hum correct na ho rahe hain.

Arre bhai, Supreme Court ka interpretation aapko pata hai? In Section 2(20) mein Company ka definition hai, jismein koi bhi entity ho sakta hai, jo is company act ke under registered ho. Court ne kaha, Company ko 'association of persons' ke taur par define kiya jaa sakta hai, jismein koi bhi entity ho sakta hai, jiski main object hai business ya anya economic activity karna.
