Shogunomics and the Battle of the Forms: United Breweries v. Bhanji

In 2006, the Supreme Court of India decided United Breweries v. Bhanji, a landmark case on the battle of the forms in contract law. The facts were as follows: Bhanji, an exporter, and United Breweries, a beer manufacturer, were parties to a contract for exporting beer. The contract stipulated a term of 30 days for acceptance. However, Bhanji sent a purchase order after 60 days, which United Breweries accepted. The court held that the acceptance was ineffective as it came after 30 days of the offer.
