S R Bommai vs Union of India (1994) - State of Emergency in India

criminal ailet advanced real_case

Arre, remember this case, AILET aspirants? The Supreme Court held that the imposition of President's Rule in Karnataka was unconstitutional. Chief Minister S R Bommai's government was dismissed without a vote of no-confidence, and President's Rule was imposed. The Court said that the President cannot impose Rule when the government is in a minority. This judgment changed the dynamics of Indian politics, especially after the 1975 Emergency.

What do you guys think about the judgment? Agree or disagree? Should the President have more powers in such situations or is it a check on his arbitrary behavior? Do you think this judgment is relevant in today's AILET perspective?
