Revisiting Bhagwan Dass v State of Delhi (1976)

evidence cuet_pg intermediate judgment_take

Yeh judgment bahut hi important hai for CUET PG Law ke liye, especially Evidence Act ke chapter 1 aur section 3 kuchh lines. Bhagwan Dass ke case me, SC ne isse clear kiya hai ki "evidence" ka definition kaha se niye jaata hai. Section 3 ke anusaar, evidence ka definition kuchh nahi hoga, lekin yeh definition bhi niye jaayega ki evidence kya hai - yaani, isme evidence ki nature aur proof ki prakriya shamil hoti hai. Isme court ne kaha hai ki "proof of existence" ka definition bhi kuchh nahi ho sakta, lekin isse iski nature aur process se sahi jaankaari mil sakti hai.

Rephrasing main points of Bhagwan Dass v State of Delhi (1976), SC upheld right to life under Article 21. Held that 'right to life' is not just physical existence but includes right to livelihood, shelter and dignity as well. This landmark judgment expanded scope of Article 21 and has significant implications on various welfare and development schemes of government. Impressive decision na!
