Rattan Lal v. Mohanlal: IPC or CPC?

cpc cuet_pg beginner real_case

In CUET PG Law, this case is a must-learn. It's about the applicability of IPC or CPC when an accused is acquitted by a magistrate and then the victim dies. You gotta know your sections, right? So, here's the case: the magistrate acquitted Rattan Lal of murder under IPC, but the victim died in police custody. Later, the trial court convicted Lal of murder under CPC (Section 304). The SC had to decide if the prosecution could proceed under CPC after an acquittal under IPC.

What do you guys think? Should the prosecution have proceeded under CPC or should the acquittal under IPC be final? Do you agree with the SC judgment or think they should have gone the other way?
