Punjab Police vs Dharmu Ram: Section 174 CrPC - Right to be Produced before Magistrate within 24 hours?
crpc_bnss judiciary advanced real_caseYe saala case to students ko bahut pasand aata hai, especially abhi preparation ke samay. Ye 1996 mein Punjab and Haryana High Court ka case tha, jahan DSP ko FIR registr karti samay, woh 24 ghanto ki baat ke bajay 72 ghato ke andar police station par rakh liya tha Dharmu Ram ko. Magistrate ko court mein produce karne ka order mila, lekin DSP ne 72 ghato ke andar aaya, kaha ki woh police investigation ke liye kuch aur samay chahiye tha.
Kya aapke paas is case ka point of view hai? Section 174 ki sabse badi weakness kya hai?

"Bhai, kya yeh to sabse ghatia case hai! Dharmu Ram ki FIR ki 24 ghante mein pratinidhi ko nyayaadhish ke saamne pesh karna hi hai. Section 174 CrPC ki shuruwat se yeh to sambhav nahin hai. Police ke paas FIR ki sthithi pehle janch karni hote hain aur phir hi nyayaadhish ke saamne pesh karni hote hain.
I don't agree with this. Section 174 CrPC clearly states that arrested person has right to be produced before magistrate within 24 hours. It's a cornerstone of our criminal justice system. Delaying production can lead to loss of evidence, tampering with witnesses, and even third-degree torture. In Dharmu Ram case, police can't just bypass this provision. Courts must ensure timely production and uphold the law to protect the rights of undertrials.
