Nike v. Adidas - The Trademark Saga

In 1989, a US District Court ruled in Nike's favour in the case of Nike, Inc. v. Adidas AG, dismissing Adidas's claim that Nike's swoosh logo infringed on their own three-stripe trademark (1989 WL 77255). The court held that the trademarks were dissimilar and Nike's use of their logo was not likely to confuse consumers.

But here's the thing - Nike's swoosh logo was actually inspired by a track coach from the University of Oregon, the original swoosh logo was a crude design and it was created by a design student, Carolyn Davidson, and paid her just 35$ for this work. Adidas's three stripes were actually inspired by the athletic shoes worn by the German army. What do you guys think - was the decision justified or was Nike just lucky?
