My Favourite Biryani Conundrum

So, every time I order my favourite biryani from that street vendor, I think of the concept of 'conclusive presumption' in Labour Laws. You see, in the case of Lachhmi Narain Light Industries Ltd vs State of Bihar (1961), the Supreme Court established the principle that if an employee is paid wages from the employer's funds after the expiry of the statutory period for payment, the employer is conclusively presumed to have employed the workman. But in real life, when I order biryani, I'm thinking - if the vendor takes more than 30 minutes to deliver, can I conclusively presume it's not going to be the 'special' biryani I ordered? Or should I just pay the labour charges for the 'standard' biryani? Guess that's a case for the Small Claims Court!
