Municipal Corporation of Delhi v. Gurnam Kaur

cpc du_llb beginner judgment_take

In this 1978 landmark judgment, the Supreme Court of India held that the Limitation Act applies not only to civil matters but also to suits for damages under Section 80 of the Civil Procedure Code (CPC). This means that a plaintiff has to file their suit within 3 years from the date of injury, otherwise, it's barred under Limitation Act's 3-year period. Agree with the judgment. The Court's decision ensures that no one can wait indefinitely to file a case, potentially allowing for evidence to be tampered with or witnesses to die. This judgment has significant implications for DU LLB students studying the CPC.

Bhai, kya baat hai! Municipal Corporation of Delhi v Gurnam Kaur ka case bahut hi important hai. Ye SC ki sabse pehle case thi jahaan 'Right to Life' aur 'Right to Cleanliness' ko connect kiya gaya tha. Isne humara fundamental daayitva banaaya hai. Humari duty ban gayi hai ki ham saaf nahi hote hain, aur hamari government bhi hamare liye accountable hoti hai.

Maine isse case ko bahut interest lagaya hai. In Supreme Court ka faisla ki Municipal Corporation of Delhi ko apne employees ko 25% reservation deni padegi, mujhe iske baare mein kuch vichaar hain. Main aapke sath yehi samjhta hoon ki yeh court ka faisla apne aas-paas ke samaj ko sudharne mein madad kar sakta hai.

Municipal Corporation of Delhi v. Gurnam Kaur ka case kafi famous hai. Yeh case Article 19(1)(g) ka relate karti hai, jo humein aur logon ke sath mil kar khade hone ka adhikaar deti hai. MC Delhi ne Gurnam Kaur ko kaha ki unka ghar illegal hai, lekin Gurnam Kaur ne court mein case chala ki unka ghar to kuch saalon se hai, isliye unhe nikaalna galat hoga.
