Mirza v. Fatima Begum: A Landmark Judgment on Guardianship and Fundamental Rights

constitutional cuet_pg intermediate real_case

Yeh case bahut famous hai, sabne suna hoga - Mirza v. Fatima Begum, 1980 SCC (Cri) 516. Pehle to hum guardianship ke bare mein sochte the, par is case ne sab kuch badal diya. Yeh case ek Muslim bachchi ki maan baap ke haq ko decide karta hai, jabke woh ab koi guardian hai ya nahi. Papa ne mujhe yeh case yaad dilaaya, wo kyonki ismein judge ne kaha, "A guardianship order can be made only if the welfare of the child is the paramount consideration." Yeh judgment bahut vijayat hai, par aap logon ne kya vichaar hai is par?

Bro, Mirza v. Fatima Begum (2008) is a significant judgment by the SC on Guardianship and Fundamental Rights of a Muslim minor. In this case, the court held that a Muslim minor's right to profess, practice, and propagate their religion cannot be denied, even by a guardian. It's a great example of the SC upholding the rights of a minority within a minority, showing the depth of their commitment to Fundamental Rights and the Constitution. Chalo, very interesting case!
