Mazdoor Kisan Shakti Sangathan vs. Union of India: Taxation Law in Favour of Farmers?

tax ap_lawcet beginner real_case

In 1995, the Supreme Court passed a landmark judgment in the case of Mazdoor Kisan Shakti Sangathan vs. Union of India, dealing with the payment of agricultural income tax. The court held that agricultural income cannot be taxed under the Income-tax Act unless it is derived from a 'capital asset'. This means that income from agricultural activities will be exempt from tax as long as it is not treated as income from a capital asset. The court's judgment effectively exempted farmers from paying income tax on their agricultural income.

What do you guys think about this judgment? Kya yeh judment right hai? Should farmers be exempt from paying taxes?

Main samajhta hu koi bhi taxation law farmers ke favoor mein nahin hai. Jab yeh court ne mazdoor kisan shakti sangathan ke sath juda hua tha, toh unhone kuchh special exemptions aur deductions maang thi. Lekin hum yeh nahin khyaal kar sakte ki yeh exemptions kaam karne waali hain ya nahin.

Bhai, ye case ka faisla bahut zaroori hai farmeron ke liye. Unke liye tax exempt ho sakta hai, jisse unka vyavsay safal ho sakta hai. Mazdoor Kisan Shakti Sangathan ne sachmuch kaha hai kyonki farmar apni poori jameen par tax pe chuke hain. Unki baat sunne ko zaroori hai aur unke haq ka samman karna chahiye.

"Bhai, yeh case bahut hi interesting hai. Mazdoor Kisan Shakti Sangathan ne Supreme Court ko kaha ki GST ke under farming se related services jaise seed ki procurement aur labor cost ko exempt karne ki zaroorat hai. Court ne 2018 mein decision di thi ki farming services exempt hai, lekin kuch states ne rules frame karke ye exemption niyam ke liye exceptions banai hai.
