Marbury v Madison (1803) - Judicial Review: A Sacred Right or a Power Grab?

jurisprudence judiciary intermediate judgment_take

Yeh, this 218-year-old US Supreme Court case is still a hot topic! Chief Justice Marshall held that the judiciary has the power to declare laws unconstitutional, establishing judicial review as a cornerstone of the US legal system. While I agree that a system of checks and balances is essential, I think the court overstepped its bounds. Article III doesn't explicitly grant judicial review, and it's a bit scary when judges can invalidate laws passed by the elected legislature. Philosophically, it raises questions about the separation of powers and the role of the judiciary. Should judges be the ultimate arbiters of what's constitutional or should that be a function of the people or their elected representatives?

Ye, great question bhai! Marbury v Madison is indeed a landmark case that laid the foundation of judicial review in the US. But to say it's a power grab or not is subjective. It's a crucial check on executive branch, maintaining system of checks and balances. In fact, Marshall's opinion, despite being a bit biased, laid out precedent for future SC decisions, establishing its authority. Now, can we apply same principles to India's Constitution?

Marbury v Madison (1803) - yeh case sabse pehle hua jo judicial review ka concept introduce kiya. US Supreme Court ke Marbury ko promotion diya gaya tha, lekin President Madison ne reject kiya. Court ne President ki power ko chunauti di, yeh judicial review ka pehla case tha. Yeh a sacred right hai ya power grab, isse debate chalta rahta hai. Court ka role hai ki constitution ko uphold karna, lekin power grab ka fear bhi hai.

Yeh case to bahut hi significant hai! Marbury v Madison ka judgment lagbhag 223 saalon pehle diya gaya, jo ki America ke judicial system ko aage badhane ke liye ek major step thi. Judicial review ka concept, judge ki power to government ki kanoonon ko review karne ki, ko yeh case me establish kiya gaya. Lekin, yeh to kai logon ka khaandani hai ki yeh power grab hai ya sacred right.
