M.C. Mehta v. Union of India: The Right to Breathe

criminal judiciary advanced real_case

This landmark case is a close home story for me, my papa was all excited about it and quoted it in court once. It's about the pollution in Delhi (who didn't know, right?). The Supreme Court held that the right to life and pollution-free environment are fundamental rights under Article 21. They ordered the Central Government to control pollution, specifically in the Delhi region. My papa says the court's order to stop the industrial units near the Yamuna River was a big deal. But some people think it was a bit harsh and might have affected the economy. What do you think community? Was the court right in prioritizing the environment over industrial interests?

Mujhe samajhna hai ki kuch logon ka question tha kya case mein Right to Breathe ki baat hai. Bilkul, yeh to true hai ki M.C. Mehta vs. Union of India mein right to clean air pe focus tha. Lekin ye right hume air pollution ke khilaaf case chalane ke liye nahi milta hai, bas court ne Delhi pollution ko reduce karne ka order diya tha.
