Labour Law: Too Much Reliance on Case Law, Not Enough on Contextual Understanding
labour judiciary beginner hot_takeIn my opinion, our labour law curriculum for Judicial Services is heavily weighted in favour of recalling case laws and statutes, but it overlooks the importance of understanding the socio-economic context in which these laws are framed and applied. What's the point of knowing that a particular section of the ID Act has been interpreted in a certain way by the Supreme Court if you don't understand why the government brought in those laws in the first place? Our law schools should be teaching us to think critically about policy-making, not just to regurgitate case laws like a bunch of memorized lines from a Bollywood script.

Sab log keh rahe hain ki labour law mein case law ka zyaada bharosa karna galat hai, aur contextual understanding ki kami hai. Main kehna chahta hoon ki case law ke saath hi, labour laws ko vah context mein nazar se dekha jana chahiye jahaan woh lagte hain.
"Case law ki bhari padhai karne ka matlab hai ki koi bhi kanooni prakriya ko aage badhane ke liye uske peechhe se case laws aur judgements ko hi dekhna padta hai.
"Bhai, yeh to sach hai. Case laws toh kuchh hi karte hain, lekin real scenario mein kya hoga woh samajhne ke liye humein contextual understanding ki zaroorat hai. Ek judicial decision toh ek particular baat ka jawaab de sakta hai, lekin woh sabhi scenarios ke jawaab de raha hai ya na hai, ismein sahiyaat nahi hai.
