Labour Law Conundrum: 'Unfair Labour Practice' vs 'Unfair Labour Conditions'

labour mh_cet_law intermediate doubt

Yaar samajh nahi aaya, please help! In Labour Law, there are two terms that sound super similar - 'Unfair Labour Practice' (ULP) aur 'Unfair Labour Conditions' (ULC). Sab kuch seemit ho raha hai. In both cases, employee's rights are getting violated, but what's the difference? ULP is mentioned in ID Act, 1947, while ULC is covered under Factories Act, 1948. But kya yeh dono hi ek jaisi cheezein hain ya alag alag concept hain? I mean, dono hi unfairness k bare me hain, lekin ULP specific employment-related issues deal karta hai, while ULC more focused on the physical working conditions. Kya main correct hoon ya main galat hoon?

Yar, this is a crucial difference in labour law! 'Unfair Labour Practice' refers to intentional employer actions violating rights/protects (like harassment or discrimination). 'Unfair Labour Conditions', on the other hand, implies inherent work environment issues (like inadequate safety or overtime). Both are crucial, but we can't ignore inherent conditions, which often stem from inadequate laws or policies.
