Labour Law Conundrum: Section 30A vs Right to Strike

labour ap_lawcet beginner concept_confusion

Tumne socha hai ki Section 30A kaha se aaya, jabki Employee vs State of U.P. me Strike ki right guarantee ki hai? Jab tum log mock tests dete ho, I'm at my shift. Okay, let's break it down - Section 30A of the ID Act says Strikes can't be called unless 60 days' notice is given, but in the Employee vs State of U.P. case, SC said workers can't be stopped from going on strike even if notice isn't given. Is it just me, or is Section 30A contradictory? Kya yeh ek special exception hai ya SC ne iske pehle ka rule cancel kiya? Mujhe aisa lagta hai ki yeh kaafi complex hai aur AP LAWCET ki paper mein yeh sab kuch samjhega na?

Main aapse nahin milte hain, sir. Main yeh sochta hoon ki Section 30A ka uddeshya hee labour laws ko sudharana hai, lekin yeh right to strike ka nishkarsh hai. Ye dhanvantari ki daldal hai, kyonki iska pratipaksh karna ek adhikar hai, jabki Section 30A ek sankat hai.
