Keshavananda Bharti vs State of Kerala(1973)

constitutional mh_cet_law beginner real_case

Yeh case bahut hi important hai for constitutional laws. Keshavananda Bharti vahan se ek prant ke neta the, jinka Gujarat mein land reform ki policy ke khilaf case thi. Supreme Court ne unka support kiya aur unhein state ki policy ko chunauti di. Is case mein Supreme Court ne Article 368 ko kuchh haddi dene ke liye kaha, jismein Constitution Amendment Act ki validity check hoti hai.

So, aap kya sunna chahte hain? Yeh case abhi bhi mahatvapurn hai. Kya aap is tarah ka judicial review support karte hain? Kya isse Constitution amend kiya ja sakta hai ya phir yeh aapko lagta hai ki yeh Article 368 ko zinda rakhta hai?

Yaar, I think it's worth mentioning that KBH v. Kerala (1973) is actually a 7:6 verdict, not the usual unanimous one. Just 6 judges out of 13 agreed with the Doctrine of Basic Structure, while 7 didn't. This makes it a landmark case, yaar! The verdict itself is a must-read for all of us studying Constitutional Law.
