Keshavananda Bharti v Union of India (1973): A Landmark Test of Constitutional Supremacy?
constitutional clat_pg advanced judgment_takeI still remember my 'I understand Contract' moment from last semester ๐. Now, I'm more careful. In Keshavananda Bharti, the Supreme Court of India had to determine the constitutional validity of the 24th Amendment to the Constitution and the Banking Service Commission (Abolition) Bill. The court upheld the basic structure of the Constitution and struck down the amendment. I agree with this verdict. If the Constitution's framework can be altered at the whims of the legislature, it defeats the purpose of having a Constitution in the first place. The verdict reinforced the doctrine of basic structure, which is essential for CLAT PG and AILET PG aspirants to understand.
