Kesavananda Bharati v Union of India (1973)

constitutional judiciary advanced judgment_take

I totally disagree with this landmark judgment, mate. In my internship, I saw how complex it made the Indian Constitution. They ruled that Parliament's power to amend the Constitution is not absolute, but the Parliament can amend or repeal any constitutional provision except those which change the basic structure of the Constitution. The problem is, who decides what constitutes the basic structure? It's like, what's the benchmark? The court said it's for the courts to decide, but that's a recipe for disaster. In theory, it seems cool to have checks and balances, but in practice, it's a bloody nightmare to navigate. I mean, what about future cases where we have a bunch of amendments? Will every judge have the same opinion on what's basic structure and what's not? It's too much to handle, honestly.

Sir, yeh case Bharatiya Constitution ke fundamental framework ko define karti hai. Supreme Court ne 24 fundamental rights jod kar Constitution Amendment Act ki validity ko challenge kiya tha. Judicial Review ki power ko maintain karne ke liye, court ne 'basic structure doctrine' ka upyog kiya, jisse future amendments ko bhi scrutiny ka vishay bana diya gaya. Abhi tak is doctrine ka prabhav Bharatiya constitutional law par hai.

Aaj hum Kesavananda Bharati case par focus karenge. 1973 mein Supreme Court mein sunwayi hui, yeh case Parliament ke powers aur Constitution ke amendments ke liye sabse mahatvapoorn case hain. Court Nani Appaji Rao case ka follow-up tha kaha jata hai, jismein Parliament ko 'Basic Structure' ki concept se jodo ka faisla liya gaya tha. Court ne kaha ki koi 'constitutional amendment' jo Constitution ke basic structure ko nahi badle, woh valid hogi.

Bhai, Kesavananda Bharati v Union of India (1973) yeh case to bahut hi famous hai. Court ne Article 368 ki interpretation mein kuch changes kiye, kaha hai ki Parliament Constitution ko modify toh sakta hai, lekin amend to nahi. Ye kafi vichar vigyan prasiddh vishay hai, ab bhi kai visheshagya is par discussion karte hain.
