Yeh case bahut hi prabhavshali hai, yaar! Kesavananda Bharati, ekk jhanda wala sevak, vajpayee sarkar ka against tha. Inhone 1964 me kai jagiron ka claim kiya, jo unke gaon ke pichle raja ki thi. Vajpayee sarkar ne 22nd amendment pass ki, jisse parliament ki powers badh gayi. KESAVANANDA BHAARTI ne SC ko case diya, ki vajpayee sarkar ka yeh amendment Constitution ka violation hai. SC ne 7:6 ki margdarshan di, jisme 7 members ne parliament ki powers badhayi aur 6 ne ki 22nd amendment ka virodh kiya.

Kesavananda Bharati v. State of Kerala (1973) ko bahut hi impaannd case mana jata hai, yeh Supreme Court ka ek pramukh decision hai. Iska matlab hai ki Parliament ki powers unme se ek bhi article ko amandit nahi kar sakti hai jo Constitution ki framework ko aapas mein juda deta hai. Court ne apne verdict mein, 'basic structure doctrine' ka concept introduce kiya, jo Parliament ke amandanshon ko bound karta hai.

Unhone kaha ki Parliament Constitution ke amendments ke liye 368 ke under kaam nahin kar sakta, jisse Constitution ke fundamental structure ko damage nahin hoga. Isse Bharat ki Constitution ko surakshit rakha ja sakta hai aur Parliament ke powers ka naya framework banaya gaya.
