Kesavananda Bharati v. State of Kerala (1973)

constitutional clat_pg intermediate real_case

Yaar, remember this one, case law ke baad sab kuch chalta hai! So, main point yeh tha ki Constitution ke basic structure ko touch nahin karna chahta tha. Parliament ki power badhne ki baat thi, aur Supreme Court ne ismein basic structure doctrine introduce kiya. Wahi yeh kehne ka faisla kiya ki Constitution ke basic structure se judi cheezein touch nahin ho sakti hain. Lekin Parliament ne isko circumvent karne ka plan taiyaar kiya, aur wahi ismein Article 368 ka istemaar kar liya. Supreme Court ne isse Constitution ke basic structure ko disturb karne ke liye reject kiya aur is prakriya ko Keshvananda Bharati ke faisla ke roop mein pasand kiya gaya.

Arre, this case changed everything! In 1973, the Supreme Court ruled in favour of Kesavananda Bharati, declaring that Parliament cannot amend the Constitution to alter its basic structure. The 24th Amendment Act was invalidated, and this case is the bedrock of judicial review in India. But some argue it was a step back for federalism, do you guys think that's true?
