Kesavananda Bharati v. State of Kerala (1973)

jurisprudence clat_pg advanced real_case

Yeh case to CLAT PG students bahut important hai. Main issue yeh tha ki Constitution ke Article 368 kya sambhalta hai. Kesavananda Bharati ne apne temple ka management control karne ke liye kanoon me change karne ki demand ki thi. Lekin court ne kaha ki Constitution ka anya bhi adhikar hai to change karna. Yeh case Constitution ka sambandh hai aur Bharat ke samvidhan ke vikalp ko samjhne ke liye bahut important hai.

So, community kehna hai ki yeh judgment bahut accha hai. Lekin kuch log yeh kehenge ki yeh judgment court ko zyada power deta hai. To, aap kya sochte hain?

Main aapki baat nahin manta, Kesavananda Bharati v. State of Kerala (1973) case ka matlab yeh tha ki Parliament ka prerogative ka badlav karega aur Constitution ko kharaab kar dega. Yeh decision toofani tha aur unka mukhya uddeshya Bharatiya constitution ke mool bhavishya ko samjhaana tha, lekin iska vikalp isne Bharat ki ghatnaon mein kya galat kiya?

Bhai, Kesavananda Bharati v. State of Kerala (1973) is a classic case! It's about the power of the Parliament and the limitation of such power. I totally agree with SC's stance on 'Basic Structure Doctrine'. It's a landmark case that gives us a framework to understand the delicate balance between Parliamentary sovereignty and judicial review. Keep rocking, and never forget the power of constitutional law!
