I'm still trying to grasp Company Law, but one thing I do know is that the Supreme Court's decision in Shriram Finance Ltd. v. Union of India (2019) left me scratching my head. The Court ruled that a non-convertible debenture (NCD) holder has the right to vote on resolutions related to the company's management, despite not being a shareholder. Main problem hai, kya ye logic hai?

The judges argued that debenture holders are essentially creditors and have a material interest in the company's affairs. I agree with this reasoning, but it seems like a one-time exception. What happens in future cases? Kya iska application limited hai to only NCD holders? I'm still trying to wrap my head around this, and I'm definitely not convinced if this judgment applies to all debenture holders or just NCD holders.

Judgment ke liye chheda kya hai, yeh sabse pahle court ke order mein likha hua hota hai. Yeh wakt hai jiske dauraan judgment court ke officer apne office se chhode aur isey apne ghar ya anya place par le jaate hain. Wakt ke chhede se judgment ki tareekh badh sakti hai ya iske aage ki sunvai mein delay ho sakta hai.

Bhai, judgment ka chheda to bahut hi zaroori hai, lekin yeh kya hai jo kai baar delay hota hai. Aam taur par 45 din ki deadline hai, lekin yeh kabhi kabhi 2-3 saal tak jaldi nahi hota. Toh iski waajah yeh hai ki bench ki capacity kam hai, aur kuchh cases priority mein hain. Humein judicial reforms ki zaroorat hai, aur judges ki sankhya badhni chahiye.
