Is Provident Fund a Part of Employer's Dues?

labour ts_lawcet intermediate question

Maine Labour Law mein PF ke baare mein padha hai, lekin yeh clear nahi hai ki yeh employer ka dut hai ya nahin? Mere teacher kehte hain ki PF ek type ka trust hai, jisme kaafi company hain, aur voh employee ke account mein paisa rakhate hain. Lekin iske baad bhi, employee ka maalik nahi hai us fund ke, aur woh fund ke paisa se employee ko bhi pata nahi chalta. To yeh kya hain, PF employer ka dut hai ya nahin? Iska kya connection hai Labour Law se? Kyaa isme koi specific provision hai jo iske baare mein batati hai?

Arre, sahi sawaal hai! (That's a great question!) Provident Fund (PF) kya employer ki daayen mein shamil hota hai yaa nahin, ye sawal kayi logon ka hai. PF ka adhikar EPFO (Employees' Provident Fund Organisation) ne dhang se define kiya hai. In sabhi cheezon par aankh rakhein, PF kya employer ka daaya hai ya employee ka savings, ye sawal hamesha jari rahega.

Yaar, I think Provident Fund (PF) is definitely a part of employer's dues. Section 4 of EPF Act clearly states that both employer and employee are required to contribute 12% of the basic wages and dearness allowance towards the fund. Employer's failure to deposit PF contributions amount to default, hence it's a part of their dues. Agree?
