Yar, novelty is indeed a crucial aspect in IP cases, but let's not forget its significance varies in different areas of law. In patent law, novelty is key as it decides whether an invention is eligible for patent protection. But in trademark law, novelty is not as important as distinctiveness, as a mark can still be registered if it's not novel but still unique and not causing confusion amongst consumers.
