Indian Airlines Ltd. v. Walsh (1976)

Yeh case to bata hoon, MH CET ke students ko bahut zaroori hai. Indian Airlines vs Walsh case me, ek foreigner passenger ne ticket book karke train chhod diya aur flight pe nahin jagaya, lekin Indian Airlines ke agent ne usko flight dete hue ticket ka refund dene se inkaar karta hai. SC ne Indian Airlines ka order suna aur kaha, "Agent ne customer ko ticket ki guarantee di thi, to usko refund milega." Yeh case me, guarantee ki definition aur uski importance ke bare me sabse achcha example hai. MH CET ke students ko isse padhkar samajh aayega ki guarantee ke kya hote hain aur uska impact hota hai commercial transactions me.

Indian Airlines Ltd. v. Walsh (1976): Bilkedar case. Walsh, a British national, was injured in Delhi. Indian Airlines refused to pay compensation citing Foreign Limitation Act, 1950. SC ruled in his favour, holding that English law applies in India due to contractual obligation. Airlines' limitation period was 3 yrs from injury, not from knowledge or discovery of injury. Important for understanding limitation periods and jurisdiction in international contracts.
