In the landmark case of Reeta Kohli vs Union of India (2000), the Supreme Court held that contract labour is a legitimate and essential tool for the economy. However, this ruling has led to a gross imbalance in the compensation and benefits of contract workers compared to their permanent counterparts.

The issue at hand is whether fair compensation for contract labour is a right or a privilege. As per the Contract Labour (Regulation & Abolition) Act, 1970, contract workers are entitled to the same wages, benefits, and working conditions as permanent employees. But in practice, this is rarely the case. The question is, should the government enforce stricter regulations to ensure fair compensation for contract workers, or should it be considered a privilege that employers may choose to provide? Main to yehe nazar se dekhna chahta hoon ki fair compensation contract labour ke liye right nahin hai, balki ek mazboot haq hai. Section 3 of Contract Labour Regulation and Abolition Act, 1970 ke under, isne state ki government ko contract labour ke adhikar ke protection ka jawaabada diya hai. Yeh ek fundamental right hai, aur isse kisi bhi privilege ke taur par samjhaya nahi ja sakta.
