D.K. Basu v. State of West Bengal (1997)

criminal clat_ug intermediate real_case

Y'all know this one right? So this was a landmark case that dealt with custodial violence, basically police torture. D.K. Basu was a journalist and CPI(M) leader who was arrested and beaten up by the Kolkata police. He alleged torture and filed a writ petition in court. The SC intervened and held that there are certain basic rights that should be followed when someone is arrested, like informing them of their rights, not arresting them in public, and not keeping them in illegal custody.

So, what do you guys think about this judgment? Agree or disagree? Do you think it's enough just to have a list of dos and don'ts for the police, or should there be more concrete measures in place to prevent police brutality?
