Concept of Vicarious Liability: A Bollywood Blockbuster Twist
labour judiciary advanced analogy_postImagine you're producing a Bollywood film, and your main actor, Shah Rukh Khan, does a crazy stunt that lands him in the hospital. The stunt master, who trained SRK for the stunt, is also sued for negligence. Here's the catch โ the stunt master is an employee of the production house, which has signed SRK on a contract. This is like vicarious liability in labour law. The employer (production house) is responsible for the employee's (stunt master) actions, even if they weren't directly involved. The reasoning is that the employer has the power to control the employee and is more likely to have the resources to compensate for the damage. Just like how the production house pays the stunt master's salary, they're also liable for his actions, and the actor's hospital bills are on the employer!
