Carom v. Shyam Sunder

contract general advanced real_case

Dude, just read about this 1995 SC decision that's been bugging me for hours. Carom vs. Shyam Sunder is all about breach of contract. The plaintiff (Carom) and defendant (SS) had a contract for the sale of carrom boards. The court decided that if the contract is breached, the aggrieved party can claim damages. But here's the twist โ€“ the court also said that if the breach is minor, the other party can't back out of the contract. I'm not getting this... can someone pls help me out?

What do you guys think about this judgment? Agree or disagree? Does a minor breach justify termination of contract?

Additional Info: Sabse pehla, yeh case IPC 323 (voluntarily causing hurt) aur IPC 506 (criminal intimidation) ke under aaya tha. Carom ne Shyam Sunder ko dobaara goli barne ke liye majboor kiya tha, jisse unho ne goli marne se pehle uski taraf dekha. Court ne ye kaam karna majboor karne wala goli barne se related nahin hai isliye Carom ko saaza mila.
