Bhim Singh vs State of Delhi, 1980: Tort of False Imprisonment

torts judiciary intermediate judgment_take

Kya yeh judgment theek hai ya nahi? I think nahi. In 1980, Bhim Singh and 40 other students were falsely implicated in a murder case and arrested. Delhi HC allowed their habeas corpus plea, terming the police action as false imprisonment.

In theory, it's a great example of the courts upholding individual rights. But in reality, I've seen such cases get dismissed with a 'lack of evidence' or 'prosecution's discretion' argument. It makes me wonder if the law is more of a theoretical framework than a practical guide. As a judicial aspirant, I'd want to know how to apply this principle in a more practical scenario, where the police might use coercive means to frame individuals.
