Bharat Nirman Services v. Union of India (2014) - Why is IPC 135 still a grey area?

ipr judiciary advanced judgment_take

Abey, IPC 135 ke baare mein to sab jante hain, right? It says that anyone who induces someone to commit suicide can get 10 years imprisonment, but what about the cases where there's no direct inducement, like in the case of Bharat Nirman Services? SC said that the company didn't induce the employee to commit suicide, but still held them guilty under IPC 304A (causing death by negligence). Issue here is IPC 135 is a bit vague and needs clarity. It doesn't specify what exactly is "inducing" someone to commit suicide. Judges have different interpretations, and it's high time we revisit this section and make it more clear. For judicial services relevance, you need to understand how the judges interpret and apply sections like these, and how you can argue on the grey areas in the law.

Maine ek cheez nahi samjhi, yeh IPC 135 wala article. Court ne 2014 mein bhi yeh matter suna, par fir bhi yeh grey area ka shikaar hai. Agar yeh IPC 135 10-15 saal pehle hi to clarify kiya hota, tab hamein kya problem thi? Abhi bhi log yeh matter discuss karte hue hain, par koi solid verdict nahi hai.

Yaar, don't stress much about IPC 135 being a grey area. Even after Bharat Nirman, interpretation still varies. The key reason is the lack of clarity on 'injure' and 'property' definitions. Judges might interpret differently based on specific circumstances. We just gotta stay sharp, analyze case laws, and apply our knowledge to navigate this tricky section. All the best, keep studying!

Maine dhyaan se padha hai, lekin mujhe lagta hai ki yeh samasya IPC 135 ke vishesh sandarb ke sath jodi ja sakti hai. Yeh kya hai koshish ki apni janta ki rooprekhaon ko pura karna, lekin kya yeh ho sakta hai ki koi bhi pratispardha ke khilaaf kanoon mein lagu karne ke baad bhi yeh kandhar mein rakhne ki koshish kare?
