Which is Correct: Fundamental Right to Education v/s Compulsory Education
constitutional clat_pg intermediate poll_styleArre yaar, I've been stuck on this Constitutional Law question for hours. For my CLAT PG and AILET PG prep, I want to know which is correct and why. Let's break it down:
The 86th Amendment Act of 2002 inserted Article 21A into the Constitution, which guarantees the 'right to education' to all citizens between 6 and 14 years of age. But, is this a fundamental right or just a directive principle of state policy? One of my friends says it's a fundamental right because it's enshrined in the Constitution, while the other says it's just a directive principle because it's not justiciable.
Option 1: The Right to Education is a fundamental right because it's enshrined in the Constitution and can be enforced by Courts.
