When You Can't Get Out of a Flat Lease: Contract Law in Action

They were locked into these crazy long-term lease agreements with the mall owner, but the mall shut down and now they're stuck paying rent for a non-existent shop. That's when Section 56 of the Indian Contract Act 1872 comes into picture. If a man has made a promise but there's no "consideration" (exchange) involved, the contract is void. But, if there is consideration, it's enforceable โ even if one party is a mall owner trying to scam people.
Same concept applies to you and me, when we sign up for a gym membership or rent a flat. If the contract is too one-sided or misrepresents facts, we can claim that it's unenforceable.
