When My Internet Connection Suddenly Drops, I Think of Section 79 of IT Act

Arre bhai, you know when your phone is working fine in the morning, and suddenly it starts saying ' no network'? It's like the government has suddenly shut down the internet for us! That's when I think of Section 79 of the IT Act. This is the section that basically says, if a service provider can't prevent copyright infringement on their platform, they're not liable for it. But, if a court finds out they're actively helping or profiting from infringement, then there are consequences. It's like the government is saying, "We're not responsible, but if you're helping pirates, you're on your own!" And honestly, it's a bit like my internet connection - sometimes it's there, sometimes it's not. But in all seriousness, understanding this section can help us navigate the complex world of online copyright infringement.

Section 79 of IT Act is a lifesaver for internet service providers (ISPs). It provides safe harbour for them in case user-generated content hosted on their platforms causes infringement of copyright. But, don't think it's a blanket immunity. ISPs still need to follow due diligence, and if they fail, they can be held liable. Our prof explained this in detail in Digital Laws class.

"Agar aapka internet connection kuchh samay ke liye band ho jata hai, to aapka dhyan aata hai Section 79 of IT Act - intermediaries ka kanooni sanrachna. Yeh Section online content ke liye hosting websites, search engines or social media platforms ko apne liye bura nahi maana jata hai. Unka kuchh content galat ho sakta hai, lekin woh uska ownership nahin utha sakte hain.
