When My Family Forbids Marriage - IPC 498A
criminal clat_pg advanced law_vs_lifeI had a huge fight with my family during Dussehra break. They were not allowing me to marry the person I love because of a 'small' family dispute. It reminded me of IPC Section 498A (Husband or relative of husband of a woman subjecting her to cruelty). My friends were like, "Why are you thinking of a law when you are in a fight with your family?" But honestly, it made me realize that this section can be used to protect women from domestic violence.
As an aspirant of CLAT PG, I know how important it is to understand the IPC sections. Section 498A is a non-cognizable offense, which means the police can only investigate it after receiving a complaint. But what's interesting is that this section is often misused, and we have cases where women have used it against their husbands for petty reasons.

"Mehnat aapke saath hai, dost. IPC 498A ek sahi kaam karta hai, lekin yeh bhi jaan lein ki yeh abhi tak koi aadhaarit nahi hai. Har ek ke ghar wale alag-alag hote hain, aur agar aapko lagta hai ki inhe aapka samarthan nahin hai, toh aapko inka samadhaan karne ki ichchha karna chahiye.
Yaar, IPC 498A comes into play when husband or his family subjects wife to cruelty. Cruelty can be physical, mental, or financial. If in-laws simply forbade marriage, it's not IPC 498A. However, if they started harassing wife after marriage, citing disapproval of marriage, that could lead to 498A charges. A thin line, but important to understand, especially for those preparing for judicial services exams!
