Samajh nahi aaya, please help! In BNS, we studied IPC sections 299 and 300. Culpable homicide is defined under sec 299 as homicide not amounting to murder (sec 300). Now, in the explanation, it's written that if a person commits culpable homicide, he may be punished with death or imprisonment for life. But wait, isn't this similar to sec 302, where punishment for murder is death or imprisonment for life? Kya faaraak hai? Culpable homicide is like, a less culpable murder, but sec 302 says murder is a punishable offence with death or imprisonment for life. Please help me out, kya to difference hai yaar?

Bhai, I feel culpable homicide and murder share a thin line, but not always. While murder requires intentionality, culpable homicide only requires rash or negligent act. But what about cases where the act is both rash and intentional? For example, if someone drives drunk and kills someone, is it murder or culpable homicide? Yaar, the law needs to be more clear on this.

Arre yaar, I don't think they get mixed up like you said. Culpable Homicide is a mens rea-less offense, whereas murder is a fully mens rea-based one. If you take Section 299, it clearly states that culpable homicide is when death is caused with intention or knowledge. Murder is when death is caused with intention and there's no defence like consent or accident. So, they're quite distinct sections.
