When Bhai Fails to Pay Up

contract bar_exam beginner law_vs_life

So, whenever my friend's cousin, Rohan, buys something from a local shopkeeper but refuses to pay the full amount, the shopkeeper always says, "Arre, bhai, yeh kya cheez hai?" And then, I'm reminded of Section 32(1) of the Indian Contract Act, 1872 - "An agreement not to be enforcible by law is where anything is done or anybody suffers or deprived of any right with the intention of causing a particular person to enter into an agreement." In other words, if someone influences you to sign a contract without your full consent, it's voidable.

Now, if Rohan's shopkeeper friend takes him to court, the court will likely consider the shopkeeper's intentions and whether Rohan was coerced into signing the contract. Simple, right? But trust me, it's not as straightforward in real life.
