What's with Section 138 of Negotiable Instruments Act?
crpc_bnss ts_lawcet intermediate concept_confusionBhai, I'm just getting tired of this one section. So, I'm reading about it for exam prep, aur yeh sab confusion ho rahi hai. So, basically, Section 138 talks about dishonour of cheques. But what I don't get is, if a post-dated cheque bounces, can the issuer be prosecuted under this section? Yeh to confusion hai ki, if the cheque was post-dated, then why is it being dishonoured? I mean, the date was yet to come? Is it just a technicality that the bank is looking for? Or is there some deeper meaning here that I'm missing? Anyone, please clarify! Tension na kare, bhai.

Arre bhai, Section 138 ke baare mein thoda jyada tension mat lein. Yeh simple hai, bas cheque bounce ke case mein application diposit aur court ke pas submit karke FIR register kar lena hai. Court will procedure follow karega, tumhe kya tension? Procedure ke baare mein aur details chahiye to share karte rahe, main tumhare saath hoon.
Bhai, Section 138 is a critical one. Yeh section mein, if a cheque bouncer hai, aur issuer ke paas sufficient balance nahi tha, toh payee ka case khada ho jaata hai. Iss case mein, payee ko 3 months ka notice dena hoga, fir 18 months ke andar case file karne ki aavashyakta hai. Case fail hone par issuer ko 2 saal ka jail or fine ka risk hota hai.
