What if a State Govt Decides to Impose a Nationwide Liquor Ban?

constitutional judiciary beginner hypothetical

Yaaar, what if tomorrow the Bihar Govt decides to ban liquor across the entire country? Can you even imagine the chaos? Okay, assume they do this. Under Constitutional Law, I think the Supreme Court would just have a field day. They'd likely use Article 19(1)(g) - the right to occupation, which includes the right to carry on any profession or trade, and Article 19(1)(a) - the right to freedom of speech and expression. The ban would be seen as a restriction on these fundamental rights. The Court might also consider the 21st Amendment to the Constitution, which allows for the prohibition of liquor in any part of the country. But here's the thing - can a state unilaterally impose a nationwide ban? That's a question of federalism and I think the Court would get into that too. It's all so complicated!

Ab aapke sawal ka jawab: kya ek Rajya SARKAR sabhi desh mein sharab beech-bandi lagataar kar sakta hai? Koi bhi Rajya SARKAR apne shasan-kshetra mein sharab beech-bandi kar sakta hai, lekin iska prabhav anya rajyo par nahi padega.
