What If a Social Media Influencer Posts Defamatory Content Against a Local Doctor?

torts ailet intermediate hypothetical

Suppose a social media influencer in our town posts a video accusing Dr. Rohan, a well-respected local gynecologist, of professional negligence. The influencer claims that Dr. Rohan prescribed wrong medication to a patient, which led to a miscarriage. The video goes viral, and the doctor receives hundreds of threatening messages and hate comments on social media. Dr. Rohan suffers immense reputational damage, loses a few valuable patients, and receives complaints from the medical council. The question is, would Dr. Rohan be able to sue the social media influencer and the platform for damages under the Law of Torts, specifically for defamation under Section 199 and Section 202 of the Indian Penal Code? What would be the evidentiary challenges, and what would be the potential compensation?

Aapke sawal ka jawaab hai - Influencer ko legal notice bhejna chahiye phir upar ka case hai. Doctor ko defamation cases mein kai options hain, jaise IPC 499 aur 500. Bina warrant se court mein case dakhil karne se shuru karein. Sabse pehle, influencer ki social media page ki ownership check karein aur apne proof ko strong banaein. Yeh sab karna doctor ke liye zaruri hai taki vah apne reputation ko bacha sake.
