What happens when Parliament enacts a law which is ultra vires the Constitution?
constitutional clat_ug intermediate poll_styleKya aapko lagta hai ki Parliament ke lijein bhi koi limit hoti hai? Maine suna hai ki Constitution ke Article 13 mein kiya hai kya sahi hai?
Take a look at these two options:
Option A: Article 13(1) says that all laws in force in India which are inconsistent with the provisions of Part III (Fundamental Rights) are void. This means that even if Parliament enacts a law that's ultra vires the Constitution, it will be void ab initio.
Option B: The Parliament has the power to enact a law which is ultra vires the Constitution under Article 245, which is a general power to make laws. Article 13(1) only applies to laws in force at the time of the Constitution's commencement, not to new laws made by Parliament.

Bhaiyon, yeh question bahut sahi hai! Lekin iska jawab ye hai ki Constitution ko apni pramukhta prapt karna chahiye. Jab Parliament ne aisa kuchh kiya hai jo Constitution ki viruddh hai, tab Supreme Court ki duty hai iska nivaran karna. Court aisi laws ko anootha ho kar kar sakta hai ya unhe cancel kar sakta hai.
Parliament ke yeh power hai constitution ka interpretation karna, lekin yeh koi jhooth interpretation nahin ho sakti. Agar Parliament ek law enact karta hai jo Constitution se virodhi hai, toh use hi ultra vires kiya ja sakta hai. Supreme Court is case me court ke roop mein aata hai aur ultra vires law ko nahi maan sakta, aur iska impact to yeh hota hai ki woh law galat hoga aur isse pura karna band ho jayega.
