Waiver of Defence - A Cricket Analogy

contract cuet_pg intermediate analogy_post

Imagine you're fielding for your college cricket team and your opponent, let's say Delhi Public School team, hits a six over the boundary. You know you can't catch it and your teammate has already signaled for a throw from the boundary. Now, in a spirit of good sportsmanship and to avoid any further arguments, you deliberately drop your arms and let the boundary be, and then signal to your teammates to throw the ball back to the pitch. This kind of 'surrender' can be seen as a waiver of your right to appeal against the boundary hit. Just like how you waivered your right to question the boundary hit to maintain harmony in the game, parties in a contract can also agree to waivered their right to dispute certain clauses or terms to avoid litigation and move forward with the agreement.
