Understanding the Anomaly of "Social Change" under K.L.Bhatia: Section 27 of the Indian Contract Act

jurisprudence clat_pg intermediate concept_confusion

Koi bat nahi hai, 3 saal se yeh padh raha hoon, par yeh section toh hamesha confusion kaa karan raha hai. Social Change ke naam par kya kya liya jaa raha hai? "If the parties to a contract intend that it shall be performed in a particular manner, the performance in that manner shall be obligatory." - Ye hai CL, par phir bhi yeh un conditions mein padta hai jahaan social change ki baat hoti hai. Toh kya aadhar yaah hai ki aadmi court ke paas social change ka option nahi hai? Ya phir iska matlab ye hai ki koi bhi contract break kar sakta hai agar uska maa-kunna change ho gaya hai?

Bhai, yaha social change ka anomaly to bahut hi complex hai. Lekin, K.L. Bhatia ko yeh kaha hai ki social change ka matlab hai yeh ki contract mein parties ko iska dhyan dena padta hai. Section 27 ke anusaar, yeh anomaly hai jo yeh dikhata hai ki contract mein party ke vikalp se badlaav ho sakta hai, jisse contract ka puraana samay band ho jaata hai.

Bhai, according to K.L. Bhatia, social changes are an anomalous concept under Section 27 of the Indian Contract Act. He argues that this concept is a departure from general principles, as it allows consideration to be past services. Essentially, this means that a promise to do something in the future can be enforced if it's made in consideration of past services, even if those services were not legally obligatory at the time.
