Understanding Key Differences in Jurisdiction Under IT Act 2008

Mainly, I was stuck on Section 79 of the IT Act, kya main samjha nahi tha (what I didn't understand). But after re-reading it thrice, I finally understood that it gives a safe harbour provision for online intermediaries, like social media platforms and online marketplaces, if they comply with the rules. Section 79(1) says that no intermediary shall be liable for any third party information or data made available or hosted by him, unless they are proved to have participated or initiated it.

Section 79(3) specifically says that the intermediaries will only be liable if they fail to preserve or retain the information or data for 90 days. It's a very technical concept, but now it's no longer a 'kamjori' for me. I'm confident I scored well in the cyber law portion at DU LLB entrance.
