Understanding 'Constructive Possession' in TPA

property du_llb intermediate definition_doubt

Main textbooks aur coaching classes hamesha kehte hain kya hai constructve posession, lekin woh samajh nahin aate. Kuch examples koi dikhate hain, par unka context to kuch aur hota hai. Meri baazi, woh examples textbook ke peechhe ki baat karte hain, par real scenario mein kya hota hai, koi nahi batata.

Koi bata sakta hai, real scenario mein constructve posession ka kya matlab hota hai? Example: Aapka dost aapki gadi chodega hai, aur ab aapki gadi wahi mein hai, par aapko kuch samjha nahin hai ki kisne woh chodega tha. Ab aapki gadi ki possession ka kya hua?

Yaar, regarding constructive possession in TPA (Transfer of Property Act), I think we often get it twisted. Constructive possession means you don't physically have the property, but you have the right to possess it (like a future owner). Think of it like your new house you bought last month, you might not have physically taken the keys yet, but the property is in your constructive possession.
