Trespass vs Nuisance: Yaar samajh nahi aaya
torts general advanced doubtBhai, I'm stuck on these two concepts. Trespass and nuisance both talk about harm caused to someone's property or person but woh don't seem related to each other at all. Trespass is about actual damage or invasion, while nuisance is about a continuous act that causes harm. But what if the trespass is also a continuous act? Does it become a nuisance? And what about the 'substantial intererence with land' criteria for nuisance? Is that just a fancy way of saying 'actual damage'?
Please help, I've been scrolling through videos of lawyers explaining this but still don't get it. It's like, suppose a person is continuously playing loud music outside my house, causing sleep deprivation and whatnot. Is that a trespass or a nuisance? Can someone enlighten me?

Bhai, don't worry yaar! Trespass and Nuisance both are torts. Trespass is physical invasion of another person's property, example: entering someone's house without permission. Nuisance is any activity causing harm or discomfort to others, like playing loud music. So, main difference is physical entry in trespass vs disturbance caused by an activity in nuisance. Got it?
"Bhai, yeh dono hain alag-cheezein. Trespass woh hai jab koi kisi ka property mein aata hai (unauthorized entry) jabki nuisance woh hai jab koi kisi ka property mein kuch karke problems paida karta hai (disturbs the property).
