Treat as an Outcast: What is 'Dominant Tenement' in TPA Really?
property general beginner definition_doubtBhai, I'm stuck on this one for 3 years now, but textbooks still can't explain it properly. Dominant tenement, aish, it's like the main guy in the joint family, but how exactly? I get that it's the one that has the power to restrict others' use, but why is it always linked with 'common' area? Someone please explain the 'common' sense behind this concept! Kya hota hai yeh commonness? And one more thing, can we give some real-life example here? I mean, a case where the dominant tenement is used effectively, or maybe where it's been misused?
